Frequently Asked Questions
Key questions on POSH Act applicability, Internal Committee constitution, and employer obligations.
1. Is POSH compliance mandatory for our company or hospital?
Yes. Under Section 4 of the POSH Act, 2013, any workplace with 10 or more employees (including full-time, contractual, interns, trainees, or visiting staff) is legally required to constitute an Internal Committee (IC) and conduct regular awareness sessions.
2. Who must be appointed to the Internal Committee (IC)?
The IC must consist of: (a) A Presiding Officer who is a senior woman employee; (b) At least two employee members committed to women’s rights or legal understanding; and (c) One External Member from an NGO or legal association familiar with sexual harassment issues. At least 50% of total IC members must be women.
3. What is the role of an External IC Member, and can NLST provide one?
The External Member prevents organizational bias, ensures unbiased proceedings, and guarantees compliance with natural justice. NLST regularly empanels experienced advocates and social jurists to serve as statutory External Members for corporates, hospitals, and educational institutions.
4. What is the statutory timeline for completing an IC inquiry?
The IC must complete its formal inquiry within 90 days from the date of the written complaint. The final inquiry report must be submitted to the Employer and District Officer within 10 days of inquiry completion, and the Employer must implement recommendations within 60 days.
5. Does the POSH Act apply to remote/work-from-home (WFH) employees?
Yes. The POSH Act defines an 'extended workplace', which legally encompasses home workstations, communication platforms (Slack, Zoom, WhatsApp, Email), client sites, and transportation provided by the employer. Digital harassment is fully actionable under the Act.
